  • CHARTER ORDINANCE exempting the City of Kansas City, Kansas, from certain provisions of K.S.A. 12-4205 relating to the preparation of complaints in the municipal court; deleting the requirement that complaints be sworn to by law enforcement officers of the City of Kansas City, Kansas; and providing substitute and additional provisions on the same subject.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF KANSAS CITY, KANSAS:

    Section 1. The City of Kansas City, Kansas, by the power invested in it by article 12, section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it K.S.A. 12-4205, relating to the preparation of complaints in the municipal court; deleting the requirement that complaints be sworn to by law enforcement officers of the City of Kansas City, Kansas; and providing substitute and additional provisions on the same subject.

    Section 2. In the event that the form of citation provided for in K.S.A. 12-4205 includes a written statement of the essential facts constituting a violation of an ordinance of the City of Kansas City, Kansas, as required by law, and is signed by the law enforcement officer of the City of Kansas City, Kansas, preparing the same, then such citation, when filed with the clerk of the municipal court, shall be deemed a lawful complaint for the purpose of prosecution under the laws of the State of Kansas and under ordinances and Charter ordinances of the City of Kansas City, Kansas.

    Section 3. This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    Section 4. This is a Charter ordinance and shall take effect 61 days after final publication unless a sufficient petition for a referendum is filed and a referendum held on the ordinance, as provided in article 12, section 5, subdivision (c)(3), of the Constitution of Kansas, in which case the ordinance shall become effective is approved by a majority of the electors voting thereon.
