  • A charter ordinance relating to Board of Public Utilities; amending section 5 and section 7 of Charter Ordinance No. CO-5-01 of the Unified Government of Wyandotte County/Kansas City, Kansas; and repealing original sections 5 and 7 of Charter Ordinance No. CO-5-01.

    BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE UNIFIED GOVERNMENT OF WYANDOTTE COUNTY/KANSAS CITY, KANSAS:

    Section 1. That section 5 of Charter Ordinance No. CO-5-01 of the Unified Government of Wyandotte County/Kansas City, Kansas be and the same hereby is amended to read as follows:

    Section 5.

    (a)

    The terms of the members of the board elected on the first Tuesday of April 2015, from non-at-large districts one and three, shall be four years, said terms expiring the second Monday of January following the November 2019 election, until successors are elected and qualified. The term of the member of the board elected on the first Tuesday of April 2013 from non-at-large district two, shall be four years, said term expiring the second Monday of January following the November 2017 election, until a successor is elected and qualified. Elections for members of the board shall be nonpartisan.

    (b)

    Commencing with the November 2017 election, the county election commissioner shall require candidates for the at-large positions to designate one of the three at-large positions sought, numbered at-large one, at-large two, and at-large three. The terms of the members of the board elected on the first Tuesday of April 2013 from at-large one and at-large two shall be four years, said terms expiring the second Monday of January following the November 2017 election, until successors are elected and qualified; the term of the member of the board elected on the first Tuesday of April 2015 from At-large three, shall expire the second Monday of January following the November 2019 election, until a successor is elected and qualified. Elections for at-large members of the board shall be nonpartisan.

    (c)

    Thereafter, except as provided in section 11, all elected members of the board shall hold their offices for terms of four years and until their successors are elected and qualified.

    Section 2. That section 7 of Charter Ordinance No. CO-5-01 of the Unified Government of Wyandotte County/Kansas City, Kansas be and the same hereby is amended to read as follows:

    Section 7.

    The nonpartisan primary election for members of the board shall be held on the first Tuesday of August in every odd-numbered year. The nonpartisan general election for members of the board shall be held on the Tuesday succeeding the first Monday of November in odd-numbered years. Both elections shall be conducted in the manner prescribed in this Charter ordinance and in applicable state statutes governing city elections.

    Section 3. If any provision of this Charter Ordinance or the application thereof to any persons or circumstances is held invalid, such invalidity shall not affect other provisions or application of the Charter Ordinance which can be given effect without the invalid provisions or application and to this end the provisions of this Charter Ordinance are declared to be severable.

    Section 4. That original section 5 and section 7 of Charter Ordinance No. CO-5-01 of the Unified Government of Wyandotte County/Kansas City, Kansas be and the same are hereby repealed.

    Section 5. This ordinance shall be published once each week for two consecutive weeks in the official Unified Government newspaper.

    Section 6. This is a Charter Ordinance and shall take effect 61 days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in article 12, section 5, subdivision (c)(3), of the Constitution of the State of Kansas, in which case the ordinance shall be effective if approved by a majority of the electors voting thereon.

    PASSED BY THE BOARD OF COMMISSIONERS OF THE UNIFIED GOVERNMENT OF WYANDOTTE COUNTY/KANSAS CITY, KANSAS, NOT LESS THAN TWO-THIRDS OF THE MEMBERS ELECT VOTING IN FAVOR THEREOF, THIS 26 DAY OF JANUARY 2017.
