§ 706. Duties of presiding officer.

  • The presiding officer shall decide all questions of order, subject to an appeal to the commission, in which event an affirmative vote of six commission members shall determine conclusively such question of order; and:

    a.

    Shall direct the sergeant at arms to carry out the orders and instructions of the chairperson for the purpose of maintaining order and decorum in the commission meeting;

    b.

    Shall determine the order of discussion and debate;

    c.

    Shall recognize as nearly as possible those individuals desiring to speak in the order in which requests are made to the chairperson;

    d.

    Shall conduct commission meetings strictly in accordance with these rules of procedure and any future rules of procedure adopted by the commission;

    e.

    Shall issue the necessary and appropriate reprimands to those individuals who are out of order;

    f.

    Shall direct the clerk to record such reprimands and votes of censure as may be directed by the commission; and

    g.

    In the event it becomes necessary to remove a person from a commission meeting or to place a person under arrest for violation of the order and decorum of the meeting, the complaint for prosecution shall be signed by the presiding officer whose actions in such matters, if approved by the commission, shall be saved harmless by the unified government.
