§ 15-23. Applicability of other laws; conflicting provisions.

  • (a)

    Nothing in this article shall be construed to nullify any ordinance governing the construction, alteration, repair, removal, demolition, use, location, occupancy, and maintenance of, or making additions to, structures and their service equipment, except as specifically provided.

    (b)

    When any provision of this article is found to be in conflict with any building, zoning, safety, health, or other applicable ordinance, the conflicting provision of this article may be waived by the chief of the fire department, the fire marshal, or any member of the fire department designated by the chief or fire marshal to grant such waiver.

    (c)

    When any provision of this article is found to be in conflict with any other ordinance, the provision that establishes the higher standard for the promotion and protection of the safety and welfare of the public shall prevail.
