§ 15-57. Violation.

  • (a)

    Any person who shall violate a provision of this article, fail to comply with any of the requirements of this article, or who erects, constructs, alters, or repairs a building or structure in violation of the approved construction documents or directive of the fire chief, or who acts in violation of a permit or certificate issued under the provisions of this article, shall, upon conviction, be punishable by a fine of not less than $100.00 nor more than $2,500.00, by imprisonment of a term not to exceed six months, or by both such fine and imprisonment, in addition to any other penalties prescribed by law. The office of chief counsel shall, at the request of the fire code official, render such legal assistance as may be necessary in carrying out the provisions of this article. Upon the request of the fire chief, the office of chief counsel shall institute in the name of the unified government the proper proceedings against any person regarding whom a complaint has been made charging the violation of any provision of this article. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

    (b)

    Application of the penalty in subsection (a) of this section shall not be held to prevent:

    (1)

    The enforced removal of prohibited conditions;

    (2)

    The restraint of any unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use;

    (3)

    The restraint, correction, or abatement of a violation; or

    (4)

    The prohibition of occupancy of a structure.
