§ 15-97. Violation; penalty.

  • (a)

    Except as provided in subsection (b) of this section, violation of any provision of this article regulating the sale or discharge of any fireworks shall be punished by a fine of not less than $500.00 or more than $1,500.00, by imprisonment in the city jail for a period not exceeding 90 days, or by both such fine and imprisonment, in the discretion of the court. Each violation shall constitute a separate offense.

    (b)

    The sale, possession, or discharge of any fireworks not approved in this article shall be punished by a fine of not less than $1,000.00 or more than $2,000.00, by imprisonment in the city jail for a period not exceeding 90 days, or by both such fine and imprisonment in the discretion of the court. Each violation shall constitute a separate offense.

    (c)

    Violation of any other provision of this article not covered by subsections (a) or (b) of this section shall be punished by a fine of not less than $100.00 or more than $500.00, by imprisonment in the city jail for a period not exceeding 30 days, or by both such fine and imprisonment in the discretion of the court. Each violation shall constitute a separate offense.

    (d)

    In addition, any violations of the provisions of this article which result in a conviction in the municipal court of the city or in any court of this state shall bar the person so convicted from obtaining city permits and licenses relating to fireworks for a period of two years.
