§ 16-3. Food to be displayed only in enclosed building; exception.

  • (a)

    It shall be unlawful for any person dealing in food products, fruits, vegetables, meats, live or dressed poultry, fish or game to display any of such products on any street, sidewalk, avenue, alley, private or public lot, or anywhere except inside a properly enclosed store building, fruit stand, poultry house, or other place of business. The term "properly enclosed place of business" shall mean a room or rooms properly screened from insects and other vermin and having properly constructed floors, sidewalks, and ceiling. The health officer shall be the authority in making decisions as to what constitutes a proper enclosure as required under the 1999 Kansas Food Code adopted in section 16-31.

    (b)

    This section shall not apply to persons selling food or food products from vehicles or stands in a manner approved by the unified government public health department and in compliance with all applicable provisions of this Code.
