In this article, the term "arena or auditorium" means any facility with an occupancy
of not less than 2,500 persons that is maintained, operated and intended for the purposes
of hosting sporting events, concerts, performances, arts events, gaming and the like,
the primary business of which is the hosting of such events and the receipt of monies
for admittance to the attendance of the same. Arenas and auditoriums maintained and
operated by public agencies and not leased to other private persons or agencies are
specifically exempted from this section.
