Article XIV. LARGE PUBLIC EVENTS |
§ 19-434. License application requirements; conditions for issuing license.
(a)
Application for a license to hold an actual or anticipated assembly of 5,000 or more persons shall be made in writing to the license administrator at least 45 days in advance of such assembly.
(b)
The application shall contain a statement made upon oath or affirmation that the statements contained therein are true and correct to the best knowledge of the applicant and shall be signed and sworn to or affirmed by the individual making the application.
(c)
The application shall provide:
(1)
The maximum number of people which will be assembled or admitted to the location of the assembly, provided that this number shall not exceed the maximum number which can reasonably be assembled at the location of the assembly in consideration of the nature of the assembly and provided that where the assembly is to continue overnight, the maximum number shall not be more than is allowed to sleep within the boundaries of the location of the assembly by the zoning and health ordinances of the unified government.
(2)
The maximum number of tickets to be sold, if any.
(3)
The plans of the applicant to limit the maximum number of people permitted to assemble.
(4)
The legal name, date of birth, telephone number, e-mail address, residence, and mailing address of all persons required to sign the application. Partnership, joint venture and corporate information must be submitted, if applicable.
(5)
The address and legal description of all property upon which the assembly is to be held together with the name, residence, and mailing address of the record owner(s) of all such property. The property owner shall also be required to sign the application.
(6)
The total number of days and/or hours during which the assembly is to take place.
(7)
Furnish at applicant's expense within ten days of submitting the application a plan approved by the director of emergency management, in consultation with the applicable department or agency:
a.
For potable water, meeting all federal and state requirements for purity, sufficient to provide drinking water for the maximum number of people to be assembled.
b.
For separate enclosed toilets for males and females, meeting all state and local specifications, conveniently located throughout the grounds, sufficient to provide facilities for the maximum number of people to be assembled.
c.
For a sanitary method for disposing of solid waste, in compliance with the state and local laws and regulations, sufficient to dispose of the solid waste production of the maximum number of people to be assembled together with a plan for holding and a plan for collecting all such waste at least once per day of the assembly and sufficient trash cans and personnel to perform such tasks.
d.
If the assembly is to continue during hours of darkness, for illumination sufficient to light the entire area of assembly but not to shine unreasonably beyond the boundaries of the enclosed location of the assembly.
e.
For providing vehicular parking. Patron parking may be located onsite or offsite. Off-site parking must include a plan for the transportation of patrons from said parking facilities to the large event site.
f.
If the assembly is to continue overnight, for camping facilities in compliance with all state and local requirements sufficient to provide camping accommodations for the maximum number of people to be assembled.
g.
For providing emergency medical services, including the method of access for such services.
h.
For adequate security and parking in and around the large event area. Said security shall include sufficient officers to provide adequate security for the maximum number of people to be assembled.
i.
For fire protection sufficient to meet all state and local standards for the location of the assembly.
j.
For traffic ingress and egress plan, sufficient to meet all state and local standards.
k.
For information, as requested by the director of emergency management, necessary to coordinate response activities in the event of an emergency.
l.
For all reasonably necessary precautions to insure that the sound of the assembly will not carry unreasonably beyond the boundaries of the location of the assembly.
m.
For food concessions and concessioners who will be allowed to operate on the grounds including the names and addresses of all concessioners.
n.
Written authorization for unlimited and unconditional 24-hour access without notice or entry fee to the large event site for inspection purposes by the following agencies: Emergency management, the county health department, the county sheriff's department, neighborhood resources department, the city fire department, and the city police department.
(8)
A bond, filed with the license administrator, either in cash or underwritten by a surety company licensed to do business in Kansas, at the rate of $1.00 per person for the maximum number of people permitted to assemble, which shall indemnify and hold harmless the unified government or any of its agents, officers, servants, and employees from any liability or causes of action, which might arise by reason of granting this license and from any cost incurred in cleaning up any waste material produced or left by the assembly or any damage to public property caused by the assembly.
(9)
The application shall include the bond required by this article and the license fee.
(10)
No permit shall be issued to any person, firm, corporation, organization or other applicant if the owner of the site or parcel on which the event will take place or a previous owner of the site or parcel has had a previous license revoked under this article within 24 months, prior to the date of the application under this article.
(11)
No permit shall be issued to any person, firm, corporation, organization or other applicant if the owner of the site or parcel on which the event will take place has outstanding financial obligations to the unified government, including but not limited to, the treasury department for real estate and/or personal property taxes, the sheriffs department, the city police department, the city fire department, the county health department, or the neighborhood resources department, for services rendered which are directly related to activities derived from a prior permit issued under this article.
(12)
In the event a state of emergency is declared by the mayor, requirements of this article may be waived by the county administrator.
