§ 21-3. Written consent of property owner or city required.

  • (a)

    It shall be unlawful for a person to do any mining on private or public property without the written consent of the owners of the property recorded in the office of the county register of deeds.

    (b)

    It shall be unlawful for any person to mine or conduct any mining operation under a public street, alley, road, highway or right-of-way without the approval of the unified government engineer.

    (c)

    It shall be unlawful to fail to leave adequate structural support to prevent cave-ins after termination of operations or abandonment.

    (d)

    The unified government engineer shall revoke the mining permit of any person violating the provisions of this section.

    (e)

    Injunction to enforce may be brought in district court.
