§ 23-17. Complaints and notices to appear; service.

  • Complaints and notices to appear shall be served upon an accused by delivering a copy to him personally, by leaving it at his dwelling house or usual place of abode with some person of suitable age and discretion then residing therein, or by mailing it to the last known address of the person. A complaint and notice to appear may be served or mailed by the clerk of the municipal court, a law enforcement officer, or by any of the following unified government employees authorized by their respective division heads to serve such complaint and notice to appear: chief counsel, assistant counsel, fire marshal, fire inspector, health inspector, building official, code enforcement officer, warrant officer, animal control officer, parking control officer, weights and measures inspector, right-of-way manager, right-of-way inspector, sheriff, sheriff's deputy, park ranger, or license inspector. No provisions of this chapter shall be construed to empower the unified government officials specified in this section other than law enforcement officers with powers of arrest, search, detention, or other powers of law enforcement officers, except as otherwise provided by law. Upon service by mail, the person mailing the complaint and notice to appear shall execute a verification to be filed with a copy of the notice to appear. The verification shall be deemed sufficient if in substantially the following form:

    The undersigned hereby certifies that on the _______ day of _______ _______, a copy of the Complaint and Notice to Appear was mailed to ___________at _______.
