§ 27-201. Withdrawal of application.

  • (a)

    An application may be withdrawn at any time prior to formal consideration by the reviewing body. Withdrawal of an application after the determination of completeness shall result in the forfeiture of fees.

    (b)

    If no public hearing is required, the applicant should give notice of the withdrawal to the director or his designate at the earliest possible time. This allows the director to notify other applicants of an agenda change.

    (c)

    If a public hearing is required, an applicant may request a withdrawal from the director at any time prior to the opening of the hearing. Once the public hearing is opened, the body conducting the hearing shall decide whether or not to approve the request and may instead act on the application.
