§ 29-5. Application of chapter.

(a)

General application. This chapter applies only to contracts solicited or entered into after the effective date of the ordinance from which this chapter is derived unless the parties agree to its application to a contract solicited or entered into prior to the effective date.

(b)

Application to unified government procurement. This chapter shall apply to every expenditure of public funds irrespective of their source, including federal and state assistance monies except as specified in section 29-606, by the unified government, acting through a governmental body as defined herein, under any contract, except that this chapter shall not apply to contracts between the unified government and other governments, except as provided in articles X and XI of this chapter, or to expenditures of the proceeds of revenue bonds issued under the authority of K.S.A. 12-1740 et seq. It shall also apply to the disposal of unified government supplies. Nothing in this chapter or in regulations promulgated hereunder shall prevent any governmental body of the unified government from complying with the terms and conditions of any grant, gift, bequest, or cooperative agreement.
