§ 29-609. Discretionary duties of the purchasing director.

  • Discretionary duties of the purchasing director shall be as follows:

    (1)

    Bonding. Notwithstanding other provisions of this chapter, the purchasing director may reduce the level or change the types of bonding normally required to accept alternative forms of security to the extent allowed by law and to the extent reasonably necessary to encourage procurement from MBEs and WBEs.

    (2)

    Progress payments. The purchasing director may make such special provisions for progress payments as such officer may deem reasonably necessary to encourage procurement from MBEs and WBEs.

    (3)

    Division of total requirements. When economically feasible, the purchasing director may divide total requirements into smaller tasks or quantities so as to permit maximum MBE and WBE participation.

    (4)

    Delivery schedules. Where the requirement permits, the purchasing director may establish delivery schedules, which will encourage participation by MBEs and WBEs.

    (5)

    Use of assistance. Use of the services and assistance of the Small Business Administration, or the Office of Minority Business Enterprise of the Department of Commerce, as required.
