§ 29-680. Membership; regulations; opinions; waiver.

  • (a)

    Membership. There is hereby created the ethics commission of the unified government, which shall be composed of the mayor, the unified government administrator and the unified government attorney. If any member of the ethics commission is unable to serve in a particular matter for any reason, the deputy mayor shall serve as an alternate member of the ethics commission.

    (b)

    Regulations. The ethics commission shall promulgate regulations to implement this article and shall do so in accordance with applicable charter ordinance and ordinary ordinance provisions. Said regulations shall be maintained in the office of the unified government administrator, and open to public inspection at all times.

    (c)

    Advisory opinions. On written request of employees or contractors, the ethics commission may render written advisory opinions regarding the appropriateness of the course of conduct to be followed in proposed transactions. Such requests and advisory opinions must be duly published in the manner in which regulations of this unified government are published. Compliance with requirements of a duly promulgated advisory opinion of the ethics commission shall be deemed to constitute compliance with the ethical standards of this article.

    (d)

    Waiver. On written request of an employee, the ethics commission may grant an employee a written waiver from the application of section 29-633 and grant permission to proceed with the transaction to such extent and upon such terms and conditions as may be specified. Such waiver and permission may be granted when the interest of the unified government so requires or when the ethical conflict is insubstantial or remote.
