§ 2-202. Duties of unified government clerk.

  • (a)

    The unified government clerk shall be authorized and charged with performance of the following duties:

    (1)

    Attending all meetings of the unified government board of commissioners;

    (2)

    Maintaining a verified record of minutes of all proceedings or meetings of the unified government board of commissioners;

    (3)

    Maintaining a record of all official actions taken by said office and attest to the same, including the signatures of the mayor, members of the unified government board of commissioners, and the county administrator;

    (4)

    Maintaining the corporate seal of the unified government;

    (5)

    Serving as the designated custodian of all records of the unified government except where state law, municipal ordinance, resolution, or administrative directive of the county administrator prescribes a different custodian or an alternative depository;

    (6)

    Maintaining a copy of all documents filed with said office and transcripts or tapes of the records of the proceedings of the council, including ordinances and resolutions duly certified by the unified government clerk under corporate seal of the unified government, and certify to the same under the corporate seal of the unified government for any lawful purpose, including their use as evidence without further proof in any court of this state;

    (7)

    Administering oaths to all elected and appointed unified government officials and to such other persons as may be required by state or municipal law to give an oath for any lawful purpose;

    (8)

    Performing such other duties as may be prescribed by the county administrator; and

    (9)

    Performing duties prescribed by any federal, state, or municipal law.

    (b)

    The duties herein assigned to the unified government clerk may be performed by the deputy unified government clerk or such person as the unified government clerk may designate.
