§ 30-129. Measurements, tests and analyses.

  • (a)

    All measurements, tests and analyses of the characteristics of waters and wastes to which reference is made in this chapter shall be determined in accordance with 40 CFR 136 or as amended, and shall be determined at the control structure provided, or upon suitable samples taken at such control structure. In the event that no special structure has been required, the control structure shall be considered to be the nearest downstream structure in the sewer to the point at which the building sewer is connected. Sampling shall be carried out by customarily accepted methods to reflect the effect of constituent upon the municipal sewer system and to determine the existence of hazard to life, limb, and property. For the purposes of self-monitoring or any compliance monitoring, all analyses shall be performed by a laboratory certified by KDHE for the performance of such testing.

    (b)

    If sampling performed by the industrial user indicates a violation, the user shall notify the control authority within 24 hours of becoming aware of the violations. The user shall also repeat the sampling and submit the results to the control authority within 30 days after becoming aware of the violation.
