§ 31-119. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Authorized representative means any employee of the public health department who is designated by the health officer to administer this article.
City includes authorized representatives of the city.
Demolition waste means waste materials from the destruction of residential, industrial or commercial structures, buildings or building sites which would include wood, rubble, concrete, iron, steel, rocks, brick and other building material.
Garbage means the animal and vegetable waste resulting from the handling, processing, storage, packaging, preparation, sale, cooking and serving of meat, produce and other foods and shall include unclean containers.
Groundwater means any water beneath the surface of the earth in any natural geologic formation.
Nuisance means any source of filth or unhealthful condition which endangers the public health and safety and/or any condition that exists that may be prohibited or declared unlawful by this article, or any condition which may result from inaction on the part of any person to do any act set out herein or may result from the unlawful use by any person of his property so as to cause a condition which is unhealthful and which endangers public health, comfort and safety.
Premises means any lot or tract of land and all buildings, structures or facilities located thereon.
Refuse means all waste substances, including, but not limited to, the following:
(1)
Garbage.
(2)
Combustible rubbish, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture and bedding.
(3)
Noncombustible rubbish, including, but not limited to metal, tin cans, metal furniture, glass, crockery and other mineral waste.
(4)
Street rubbish, including, but not limited to street sweepings, dirt, leaves and catchbasin cleanings.
(5)
Ashes, including residue from fires used for cooking and for heating buildings.
(6)
Solid and semisolid wastes resulting from industrial processes and manufacturing operations and demolition wastes.
The term "refuse" does not include any unprocessed earth, stone or minerals.
Rubbish means solid waste other than garbage, including residential, commercial, industrial, manufacturing and municipal waste.
Sanitary landfill operation means a method of disposing of refuse on land without creating nuisances or hazards to the public health or safety by confining refuse to the smallest practical area, compacting it to the smallest practical volume by employing approved power equipment, and covering with a layer of compacted earth or other suitable cover material at the conclusion of each day's operation.
Solid waste includes, but is not limited to, refuse, garbage, rubbish, dead animals, discarded appliances, abandoned vehicles, industrial wastes, demolition and construction wastes and digested sludges resulting from the treatment of domestic sewage.
Solid waste disposal site means any site used for the disposal of refuse from more than one residential premises, or one or more commercial or industrial manufacturing operations.
Surface water means any body of water, the top surface of which is exposed to daylight, including flowing bodies, as well as ponds and lakes.
