§ 31-124. Same—Penalties.

  • The violation of this article or any orders issued under the provisions of this article shall be deemed a misdemeanor, and any person who violates any provisions of this article shall, upon conviction, be punished by a fine of not less than $500.00 and not exceeding $2,000.00, by imprisonment in jail for a period not exceeding 90 days, or by both such fine and imprisonment, in the discretion of the court. In determining the amount of fine, the court may take into consideration such factors as including, but not limited to, amount of refuse involved, the number of previous violations, and the nature of the violation. Each day any violation of this article shall continue shall constitute a separate offense.
