§ 32-59. Findings and purpose.

  • The following are hereby declared to be the legislative findings necessitating the regulation of vending of food and merchandise on public property:

    (1)

    The primary purpose of the public streets, alleys, lanes, thoroughfares, sidewalks and parks is for vehicular and pedestrian use with all other purposes and uses ancillary thereto and therefore subject to regulation.

    (2)

    Regulated vending of food and merchandise on the public areas and sidewalks promotes the public interest by contributing to the competitive commercial activity of the city and to the convenience and needs of a pedestrian environment.

    (3)

    Regulation of the location, hours and manner of operations, owners and operators, and means of distribution, protects the public interest by promoting the efficient and unimpeded movement of vehicular and pedestrian traffic, promotes the health and welfare in the consumption and sale of food for immediate consumption and protects the public from fraud and harm by requiring financial protection and reasonable identification of owners and operators of vending devices.

    (4)

    The regulation of vending vehicles and vending stands promotes the intent of zoning classifications by promoting the quiet use and enjoyment of private property, limits the invasion and intrusive effects upon personal privacy in residential districts and enhances and restricts commercial activities to areas where such are consistent with other uses.
