§ 32-207. Franchise application and renewal.

  • (a)

    Any applicant who wishes to use the public rights-of-way within the limits of the city shall make written application setting out such information as required on a form prescribed by the unified government.

    (b)

    Applicants shall file their applications with the unified government clerk.

    (c)

    Applicants shall submit with their application a nonrefundable application fee in an amount to be set by the county administrator. Such fees may vary depending upon the type of franchise sought.

    (d)

    The unified government reserves the right to request reimbursement for its reasonable expenses associated with the review, negotiation, and franchise grants that may reasonably exceed the application fee amount.

    (e)

    Franchise renewals shall be in accordance with applicable law. The city and any franchisee, by mutual consent or as otherwise provided in such franchisee's franchise, may enter into renewal negotiations. The city may require such franchisee to update any application information and, subject to Kansas Statute or any provisions in such franchisee's franchise, submit an application fee.
