§ 32-215. Preservation of police power authority and applicability of regulations.

Any rights granted pursuant to this chapter or pursuant to any franchise are subject to the authority of the city to adopt and enforce ordinances and regulations necessary to the health safety and welfare of the public. All entities subject to this chapter shall also be subject to and comply with all applicable federal and state laws, statutes and regulations, and all applicable rules, regulations, policies and ordinances enacted by the city, including but not limited to, the city's ordinance for construction and use of rights-of-way. Provided, nothing in this chapter shall be deemed to waive a right, if any, that an entity might have to seek judicial or regulatory review as provided by law.
