§ 33-1. Territorial applicability; definitions.

  • (a)

    This chapter applies to all territory under the jurisdiction of the unified government.

    (b)

    The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Director means the director of the health department.

    Family pool means a swimming pool used or intended to be used solely by the owner, operator, renter or lessee, such person's family, and by friends invited to use it without payment of any fee and is distinguished from a public or semipublic pool that is not used clearly as a private family pool.

    Health department means the county public health department.

    Hearing officer means the health director or a representative designated by the health director for the purpose of conducting hearings in accordance with this chapter.

    Natural swimming place means any natural lake, artificial lake, pond or other natural body of water, including a river or stream used for swimming purposes.

    Swimming pool means any artificial basin, chamber or tank constructed of impervious materials and used or intended to be used for swimming, diving, wading or recreational bathing that has a water depth of two feet or more at any point, other than a family pool.

    Wading pool means any swimming pool used or intended to be used primarily for wading by small children that has a maximum water depth of less than 24 inches at the deepest point. The term "wading pool" does not include a family pool.
