§ 33-52. Application; issuance; term; transfer.

  • (a)

    All applications for permits required by this article shall be made to the public health department on forms provided for this purpose and shall contain pertinent information to show that the swimming or wading pool is or will be constructed and equipped in a manner that will enable it to be operated in compliance with the requirements of this chapter. Properly executed permit applications for new or altered swimming or wading pools shall accompany the plans submitted to the department under the provisions of section 33-12.

    (b)

    Upon receipt of a permit application from the owner of a swimming or wading pool constructed prior to the effective date of the ordinance from which this chapter is derived, the public health department shall make such investigations as it deems necessary to determine that the swimming or wading pool is located, constructed and equipped in compliance with the provisions of this chapter. Whenever the department finds that a swimming or wading pool is located, constructed and equipped in compliance with the provisions of this chapter and a properly executed application for a permit has been received, the public health department shall issue a permit to the owner of the swimming or wading pool.

    (c)

    The permit shall be valid for one year from date of issuance or until it is revoked or the ownership of the swimming or wading pool is changed. Each permit shall be issued for a specific pool to the person named in the application and shall not be transferable or assignable except with written approval of the health director or the director's authorized representative.
