§ 35-646. Removal of traffic hazards.

  • (a)

    It shall be the duty of the owner, occupant or agent of the owner of real property to remove from such property any tree, plant, shrub, or other obstruction that by obstructing the view of any driver constitutes a traffic hazard.

    (b)

    When the traffic engineer determines upon the basis of an engineering and traffic investigation that such a traffic hazard exists, the traffic engineer shall notify the owner or occupant and order that the hazard be removed within ten days.

    (c)

    The failure of the owner or occupant to remove such traffic hazard within ten days shall constitute an offense punishable by a penalty of not less than $100.00 nor more than $500.00, by 90 days in jail, or by both such fine and imprisonment, and every day the owner or occupant shall fail to remove it shall be a separate and distinct offense.
