§ 35-960. Application for and issuance of permits.

  • (a)

    Each applicant for a permit within a residential permit parking area must submit a signed application stating:

    (1)

    The name and residential address of the owner of the vehicle;

    (2)

    The name, residential address, and driver's license number of the principal operator of the vehicle; and

    (3)

    The make, model, license plate number, and registration number of the vehicle.

    (b)

    A fee shall be charged for the issuance of a permit under this article in an amount to be set by the county administrator.

    (c)

    If an applicant is eligible for a residential parking permit under this article, upon the applicant's payment of the fee, the traffic engineer shall issue a permit for the vehicle described in the application.

    (d)

    No residential parking permit shall be issued to a vehicle whose owner or principal operator do not reside within the designated residential permit parking area. The traffic engineer may require documentation of residency in whatever form he deems sufficient.

    (e)

    A residential parking permit shall be issued only to vehicles with valid state license plates, unless the vehicle is not required to have them.

    (f)

    If one or more of the requirements of this article is not met, the traffic engineer may refuse to issue a residential parking permit. Any applicant who is denied a residential parking permit by the traffic engineer may appeal that decision by filing a written notice of appeal within ten days with the county administrator, stating the basis for the appeal. The county administrator or a designated representative shall hold a hearing at which the applicant may appear and present evidence. After reviewing the evidence, the county administrator or a designated representative will issue a written decision upholding or reversing the decision of the traffic engineer.
