§ 36-25. Records of transactions.

  • (a)

    At the same time of making a loan, a pawnbroker shall maintain the record in a book kept for that purpose and enter the record electronically to an inventory-tracking system, which is capable of delivery and transmission of all required information pursuant to this article via computer to the chief of police or his designee using an internet website approved by the chief of police, or his designee or his designee:

    (1)

    The date, duration, amount and charges of every loan made by the pawnbroker.

    (2)

    An accurate description of the property pledged or purchased, including manufacturer's name, model name, model number, serial number and any other identifying marks. In the case of jewelry, all letters and markings inscribed thereon, along with approximate size, color, shape of all stones, must be included in the description.

    (3)

    The full name, address, date of birth, age and valid driver's license or other approved state identification, military I.D., alien I.D., or valid passport number must appear on the report filed with the police department. If the customer is known to the pawnbroker, the driver's license or other approved state identification number will be waived if the pawnbroker can produce such information upon request by the police department.

    (4)

    All reports must be neat and legible in hardcopy and must be electronically submitted as required by this section .

    (b)

    At the time of purchasing precious metal, a precious metal dealer shall enter in a book kept for that purpose and post and upload all transaction description records to the approved internet website as described in this section:

    (1)

    The date of the purchase.

    (2)

    A full and accurate description of each item purchased, including any identifying letters, numbers or marks on the item.

    (3)

    The full name, address, date of birth, age and valid driver's license or other approved state identification, military I.D., alien I.D., or valid passport number must appear on the report filed with the police department. If the customer is known to the pawnbroker, the driver's license or other approved state identification number will be waived if the pawnbroker can produce such information upon request by the police department.

    (4)

    All reports must be submitted electronically to an inventory-tracking system, which is capable of delivery and transmission of all required information pursuant to this article via computer to the chief of police or his designee using an internet website approved by the chief of police, or his designee.

    (c)

    The records required by this section shall be maintained by the pawnbroker or precious metal dealer at the pawnbroker's or dealer's place of business for not less than one year following the date of the transaction.
