§ 36-47. Required; limitation on number issued.

  • (a)

    No person shall engage or continue in business as a pawnbroker or precious metal dealer without first obtaining a license from the license administrator.

    (b)

    The unified government hereby authorizes and restricts the number of pawn broker licenses be issued pursuant to the authority of the license administrator under this section to a total of seven at any time. The unified government hereby authorizes and restricts the number of precious metals dealer licenses be issued pursuant to the authority of the license administrator under this section to a total of 15 at any time. The manner in which applications shall be accepted and processed are set forth in section 36-48 of this division. The county administrator shall semi-annually convene an advisory commission of persons from the pawnshop and precious metal dealer industry, police department, license department, legal department, and community to consider and make recommendations to the unified government board of commissioners whether a change in the number of permitted licenses is warranted based upon, but not limited to, the demand for said licenses, the economic condition of the community, regulatory problems associated with the existing facilities and such other criteria as the commission shall deem appropriate and identifies as relevant to their recommendation to the unified government board of commissioners.
