§ 36-49. Persons eligible.

  • No license required by this article or any renewal shall be granted to:

    (1)

    Any person who is not a citizen of the United States.

    (2)

    Any person who has not been an actual resident of the state for at least two years immediately preceding the date of the application.

    (3)

    Any person who has been convicted of or has pleaded guilty to a felony under the law of this state, any other state, or the United States, or any person who shall have forfeited a bond to appear in court to answer charges for any such offense within the ten years immediately prior to such person's application for a license.

    (4)

    Any person who has had his license revoked for cause under the provisions of this article.

    (5)

    Any person who is not at least 21 years of age.

    (6)

    Any person who at the time of application for renewal of any license issued under this article would not be eligible for such license upon a first application.

    (7)

    Any person who does not own the premises for which a license is sought, unless such person has a written lease for such premises for at least three-fourths of the period for which the license is to be issued.

    (8)

    Any person whose spouse would be ineligible to receive a license hereunder for any reason other than the age, citizenship and residence requirements.

    (9)

    Any partnership, unless all of the partners shall be eligible to receive a license as an individual.

    (10)

    A corporation, if any officer, manager, director or stockholder would be ineligible to receive a license as an individual.

    (11)

    Have a net asset of at least $130,000.00 readily available or alternatively, file a surety bond in that amount in favor of the unified government for use in conducting the business of each licensed pawnshop or precious metals dealer; and show that the pawnshop or precious metals dealer will be operated lawfully and fairly within the purpose of this article.

    (12)

    For the 2012 calendar year only, any person who applies for a precious metals dealer license who does not operate as a retail jewelry store primarily dealing in precious metals, in a commercial setting open to the public and with normal business hours.
