§ 36-84. Sale of uninventoried or specially ordered articles prohibited; replenishing stock prohibited.

  • It shall be unlawful, at any auction sale governed by the provisions of this article, for any person to advertise, sell or offer for sale any goods, wares or merchandise which are not listed in the inventory filed pursuant to section 36-122 or to make any replenishment or addition to such stock for the purpose of such sale. No person who contemplates making application for a license under this article or who intends to conduct an auction sale shall order any goods, wares, or merchandise for the purpose of selling and disposing of the same at any such auction sale, and evidence of any unusual addition to the stock of any applicant for such a license within 60 days prior to the date of filing an application for a license shall be considered presumptive evidence that such purchases and additions were made in contemplation of such sale and for the purpose of selling such goods, wares and merchandise at such sale.
