§ 37-59. Application.

  • An application for a livery vehicle business license shall be filed with the license administrator upon forms provided by the unified government. The application shall furnish such information as the license administrator may require including, but not limited to, the following:

    (1)

    The name of the titleholder and, if applicable, leaseholder of each livery vehicle, residence and business address of each titleholder and, if applicable, the leaseholder, and, if the titleholder or leaseholder is a firm, corporation, partnership, association or business organization, the members and the managers of such firm, association, or business organization, the partners and managers of such partnership or the principal shareholders, directors, officers and managers of any such corporation.

    (2)

    The name of the firm, corporation, partnership, association or business organization, the members and managers of such firm, association, or business organization, the partners and managers of such partnership, or the principal shareholders, directors, officers and managers of any such corporation under whose agency and livery vehicle shall be operated if different from the titleholder or leaseholder.

    (3)

    A complete description of each vehicle including the number of persons it is constructed to carry, the make, the model, the year, the vehicle identification number and the state vehicle registration number.

    (4)

    The address where the livery vehicle will be housed and maintained and the address where all trip and time records will be stored.

    (5)

    The design, color scheme, characteristic insignia, lettering and marks to be used on each livery vehicle.

    (6)

    The length of time each livery vehicle has been in use as a livery vehicle.

    (7)

    The past experience, if any, that the applicant has had in rendering such licensed service in the city and the period of time that the applicant has rendered such service.

    (8)

    The name of any vehicle liability insurance company to which application has been made for vehicle liability insurance coverage.

    (9)

    Whether or not any person or entity listed in subsection (1) or (2) of this section has been convicted of a violation of any federal or state felony law or, within the previous 12 months, has violated any provisions of this chapter or its predecessor limousine ordinance.

    (10)

    Whether or not any person or entity listed in subsection (1) or (2) of this section has unpaid claims or unsatisfied judgments against such person for damages resulting from negligent operation of a vehicle.

    (11)

    Whether or not a taxicab or livery vehicle certificate, license or permit issued to any person or entity listed in subsection (1) or (2) of this section by the unified government or by any other city, by any state or by any political subdivision of any state has been revoked or suspended, and, if so, the circumstances of such revocation.

    (12)

    Whether or not a taxicab or livery vehicle certificate, license or permit has been issued to any person or entity listed in subsection (1) or (2) of this section by any other city, by any state or by any political subdivision.

    (13)

    A description of the proposed operation, including a schedule of fares that will be initially charged by each livery vehicle.

    (14)

    Such further information as the license administrator may reasonably require.
