§ 4-11. Furnishing alcoholic liquor or cereal malt beverages to minors; minors on premises.

  • (a)

    It shall be unlawful for any person to give, furnish, deliver, sell to or buy any alcoholic liquor or cereal malt beverage for a minor, herein defined to be any person under the age of 21 years, except as may hereinafter be provided. It shall be a defense to a prosecution under this subsection if:

    (1)

    The defendant is a licensed retailer, club, drinking establishment or caterer or holds a temporary permit, or an employee thereof;

    (2)

    The defendant sold the alcoholic liquor or cereal malt beverage to the minor with reasonable cause to believe that the minor was 21 or more years of age or of legal age for the consumption of alcoholic liquor or cereal malt beverage; and

    (3)

    To purchase the alcoholic liquor or cereal malt beverage, the person exhibited to the defendant a driver's license, state nondriver's identification card or other official or apparently official document, containing a photograph of the minor and purporting to establish that such minor was 21 or more years of age or of legal age for the consumption of alcoholic liquor or cereal malt beverage.

    (b)

    This section shall not apply to the furnishing of cereal malt beverage by a parent or legal guardian to such parent's child or such guardian's ward when such furnishing is permitted and supervised by the child or ward's parent or legal guardian.

    (c)

    No person under the legal age of consumption shall be permitted to buy or drink any cereal malt beverage in or about any place of business selling cereal malt beverages, nor shall any person whose principal business is the selling of cereal malt beverages permit any person under the legal age of consumption to be in or remain in or about such place of business unless such minor is accompanied by such minor's parent or legal guardian.

    (d)

    No person under the legal age of consumption shall attempt to enter or remain on or about the premises of any place of business that is primarily engaged in the selling of cereal malt beverages, unless such minor is accompanied by such minor's parent or legal guardian.

    (e)

    This section shall not apply to the furnishing of cereal malt beverage by a parent or legal guardian to such parent's child or such guardian's ward.
