§ 6-56. Conditions.

  • In addition to other requirements set forth herein, the applicant for the license required by this division shall furnish suitable evidence of the intention and ability to comply with the following conditions:

    (1)

    The operator, sponsor, manager and employees of the carnival or exhibition shall each be wholly responsible for maintaining order and for keeping the site clean, free of trash, papers and other debris. Trash containers in adequate number shall be placed in convenient locations for the use of the public.

    (2)

    No rides shall be placed in operation for public use until the same have been inspected for mechanical, structural, electrical and other hazards by the building official and such other officers or employees of the unified government having jurisdiction. Adequate safeguards shall be placed to protect both operators and the general public from inadvertently coming into contact with moving parts, belts, motor gears, electrical switches, and other possible or potential hazards. The operator of the carnival shall be responsible for paying the costs of each inspection and any repairs required to be made before operation of the ride or mechanical device.

    (3)

    Insurance is furnished in accordance with section 6-57.

    (4)

    For the purpose of preserving and maintaining order, there shall be on the premises, at all times during the hours of operation of such amusement enterprise, one representative sworn law enforcement officer of the police department, or the sheriff's department, or one licensed security guard. Such representative shall be selected and paid at an agreed upon hourly rate by the operators of the carnival or amusement enterprise and shall have power to temporarily close the carnival or amusement enterprise if conditions occur which, in that person's judgment, amount to a disturbance of the peace.
