§ 8-452. Order to repair, remove or demolish.

  • (a)

    If, after the notice and hearing provided for in the complaint issued pursuant to section 8-451, the public officer determines that the structure under consideration is unfit for human use or habitation, he shall state, in writing, findings of fact in support of such determination and shall issue and cause to be served upon the owner thereof an order which:

    (1)

    If the repair, alteration or improvement of the structure can be made at a cost which is less than both 25 percent of the replacement value and 100 percent of the appraised value of the structure, requires the owner, within the time specified in the order, to repair, alter, or improve such structure to render it fit for human use or habitation or to vacate and close the structure until conformance with all applicable ordinances. The values of the structure, for purposes of this order, are to be determined by the public officer, and the order shall also include the estimated cost of compliance; or

    (2)

    If the repair, alteration or improvement of the structure cannot be made at a cost which is less than both 25 percent of the replacement value and 100 percent of the appraised value of the structure, requires the owner, within the time specified in the order, to remove or demolish such structure. The values of the structure, for purposes of this order, are to be determined by the public officer, and the order shall also include the estimated square footage of the structure.

    (b)

    If an order of demolishment or removal is entered by the public officer, no building permits shall be issued for repair, altering or improvement of the structure. This restriction shall remain until the structure is removed or demolished or until the order is modified or rescinded in writing by the public officer.
