§ 9-7. Acquisition of interest in project or program by public officials or employees; effect; disclosure.

  • (a)

    No public official, member of the unified government board of commissioners, or employee of the department or agency of the unified government responsible for the administration of community development block grant funds, shall voluntarily acquire any interest, direct or indirect, in any rehabilitation project or program or any property included or planned to be included in any rehabilitation project or program of the unified government or any contract or proposed contract in connection with such rehabilitation program. When such acquisition is not voluntary, the interest acquired shall be immediately disclosed in writing to the unified government administrator, and a record of such interest shall be maintained by the unified government clerk.

    (b)

    If any such official, member of the unified government board of commissioners, or employee presently owns or controls or owned or controlled within the preceding two years any interest, direct or indirect, in any property which such person knows is included or planned to be included in a rehabilitation project or program, such person shall immediately disclose this fact in writing to the county administrator, and such disclosure shall be maintained in the file contained by the unified government clerk. Such official, member of the unified government board of commissioners or employee shall not participate in any action of the unified government affecting such property.

    (c)

    Any participation of any employee of the unified government other than a public official, member of the unified government board of commissioners or employee of the department responsible for the administration of community development block grant funds shall be approved by any department of the unified government only with the direct authorization of the county administrator.

    (d)

    This section shall not be applicable to rehabilitation provided by home mortgage revenue bonds issued by the unified government.
