§ 16-35. Penalty.

  • (a)

    Upon first conviction of violating or failing to comply with any of the provisions of this article, a person shall be punished by a fine of not less than $100.00, by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment. Upon a second conviction of violating or failing to comply with any of the provisions of this article, a person shall be punished by a fine of not less than $400.00, by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment. Upon a third conviction of violating or failing to comply with any of the provisions of this article, a person shall be punished by a fine of not less than $1,000.00, by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment. Upon a third conviction, the court shall revoke the person's permit to operate a retail food store.

    (b)

    Each day upon which such a violation occurs constitutes a separate offense.
