§ 19-227. Applicability and exceptions.

  • (a)

    The provisions of this article shall apply to all rental dwellings and dwelling units, including rented single-family dwellings and rented dwelling units in owner-occupied dwellings.

    (b)

    The provisions of this article shall not apply to hotels, motels, jails, convents, monasteries, licensed nursing homes, licensed board and care homes, parsonages, parish houses, manses and rectories, hospitals, dwelling units in a cooperative or condominium building, and residential dwelling units owned and operated by the city housing authority.

    (c)

    The provisions of this article shall not apply to a bona fide sale of a residential rental dwelling to the resident/occupant by a contract for deed or similar instrument; provided that any such instrument or an affidavit of equitable interest which specifically identifies the instrument is properly executed and filed of record with the register of deeds of the unified government and a file-stamped copy of said instrument is provided to the public officer.
