§ 29-610. Certification; remedies for supplying incorrect supporting information; notice and hearing.
(a)
Certification. In order to qualify for any of the provisions of this division, MBEs or WBEs must obtain prior certification of such status from the human resources department. Note: Currently the human resources department does not issue certificates verifying a company is a bona fide MBE-WBE.
(b)
Remedies. A business which has been classified as an MBE or a WBE under this division by having furnished incorrect supporting information and which has thereby been awarded a city contract may be subject to any of the following remedies by the purchasing director, in conjunction with the director of the human resources department:
(1)
Termination of contracts with the city;
(2)
An assessment of not more than five percent of the total contract amount;
(3)
An assessment of the difference between the contract amount and what the costs would have been if the contract had been properly awarded;
(4)
Temporary debarment from transacting any business with the city for a period of not less than three months and not more than 24 months; and
(5)
Permanent debarment from being a contractor under city contracts.
