§ 30-35. Issuance, modification, and transfer.

  • (a)

    If, after examining the information contained in the wastewater discharge permit application, it is determined by the director that the characteristics of the proposed discharge do not conflict with the provisions of this chapter and the wastewater discharge permit fee is paid, a wastewater discharge permit shall be issued allowing the discharge of such wastes into the public sewers. If it is determined that a proposed discharge containing materials in excess of the limitations imposed by this chapter will not be harmful to the operation of the treatment plant, then a conditional (temporary) wastewater discharge permit may be issued for the period of time determined by the director as noted on the permit but in no event for longer than one year from the date of the issuance.

    (b)

    Within three months of the promulgation of a national categorical pretreatment standard, the wastewater discharge permit of the users subject to such standard shall be revised to require compliance with such standard within the period prescribed by such standard. Where a user, subject to a national categorical pretreatment standard, has not previously submitted an application for a wastewater discharge permit, the user shall apply for a wastewater discharge permit within 180 days after the promulgation of the applicable national categorical pretreatment standard. In addition, the user with an existing wastewater discharge permit shall submit to the director within 180 days after the promulgation of an applicable federal categorical pretreatment standard, the information required by the director to verify compliance.

    (c)

    Wastewater discharge permits are issued to a specific user for a specific operation. A wastewater discharge permit shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operator without the written approval of the director. However, the industrial user is required to provide a new owner with a copy of any existing wastewater discharge permit for information and reference. The new owner shall apply for a wastewater discharge permit in the name of the new owner within 30 days of possession of the property.
