§ 31-5. Garbage cans and containers.

  • (a)

    Every owner, tenant, housekeeper, or other person occupying any dwelling house, apartment house or other building, or a portion thereof in the city and producing garbage shall provide, and renew, when notified by the proper city officials, which may be given to the owner, tenant, housekeeper, or person occupying the premises by placing on such garbage cans a tag stating when such cans must be renewed, a sufficient number of garbage cans to hold the garbage accumulating thereat. All garbage cans shall be of galvanized or other rust-resistant metal, plastic or rubber with tightfitting covers and strong handles on the outside and shall be watertight. Each can shall have a capacity of not more than 50 gallons and shall not weigh more than 75 pounds when full. All garbage cans shall be maintained by the user in good and sanitary condition.

    (b)

    The storage of garbage in commercial, business and industrial locations may be in cans or containers of a size and type of construction approved by the health officer.

    (c)

    Notwithstanding subsection (a) of this section, garbage may be placed in plastic bags, provided:

    (1)

    The capacity of the bag is not more than 50 gallons; and

    (2)

    The weight of the bag when full does not exceed 75 pounds.
