§ 3-18. Opacity requirements.

  • (a)

    Generally. Subject to the provisions of sections 3-7 and 3-19, no person shall cause or permit, from the processing of any materials or other use of any premises, the emission of visible air contaminants from any source, new or existing, which equal or exceed visible emission of 20 percent opacity, except as otherwise specifically permitted in other emission control regulations.

    (b)

    Time for compliance. All sources not presently in compliance with subsection (a) of this section shall be deemed in violation of this regulation and subject to penalties prescribed, unless a time for compliance schedule has been received and accepted by the director.

    (c)

    Visible emissions from motor vehicles and stationary internal combustion engines.

    (1)

    No person shall cause or permit the emission of visible air contaminants which equal or exceed 20 percent opacity from a gasoline-powered motor vehicle or stationary gasoline-powered internal combustion engine for longer than five consecutive seconds.

    (2)

    No person shall cause or permit the emission of visible air contaminants that equal or exceed 30 percent opacity from a diesel-powered motor vehicle or diesel-powered stationary internal combustion engine for longer than five consecutive seconds. At no time may the emission of visible air contaminants from diesel-powered motor vehicles be of an opacity equal to or exceeding 50 percent opacity.

    (d)

    Opacity contribution of uncombined water not included. Visible contaminant emissions of an opacity exceeding that allowed in subsection (a) of this section shall not be considered in violation of subsection (a) of this section; provided that the person responsible for the processing of materials or other use of the premises demonstrates to the satisfaction of the director that such failure to comply is solely the result of the presence of uncombined water in the plume.
