§ 37-97. Unfair claims handling practices.

  • It shall be unlawful for a licensee under this chapter to commit or perform any of the following in the handling of claims:

    (1)

    Misrepresent insurance policy provisions relating to coverages at issue.

    (2)

    Knowingly misrepresent applicable laws.

    (3)

    Fail to acknowledge and act reasonably promptly upon written or oral communications with respect to claims.

    (4)

    Fail to adopt and implement reasonable standards for prompt investigation of claims.

    (5)

    Refuse to pay claims without conducting a reasonable investigation based upon all available information where material facts are in dispute.

    (6)

    Fail to affirm or deny a reported claim within a reasonable time after investigation of the circumstances.
